There is nothing more frustrating to conservatives than seeing something interpreted as constitutional despite no mention of it being made in the entire document. You might expect that an issue would then fall to the states to handle, but thanks to Alexander Hamilton, the federal government has the argument of “implied powers” in their back pocket.
Hamilton used so-called “implied powers” to fight for national institutions and diminish the role of the states. Most famously, he used these “implied powers” to fight for the assumption of state debts which he would then use to embolden his own position as treasury secretary.
